Carrier Connection Rental Agreement
These terms and conditions are subject to change without notice.
Rental Period:
The rental period begins on the date the package is marked as delivered by the carrier. Rentals are available in 1-week, 2-week, 3-week, or 4-week increments. The rental period ends either after the specified rental duration or the date the package is marked as shipped by the carrier, whichever comes first.
Rental Fees:
The Renter agrees to pay Carrier Connection the specified rental fee in advance, as outlined on the item details page. This fee is non-refundable.
- Postage fees must be paid for postage both to the Renter and for returns to Carrier Connection.
- If the Renter applies and is approved to buy the rental equipment, only the return postage fee will be credited towards the purchase – the original postal fee to send the carrier to the Renter will not be credited or refunded in any way.
- Rental and Library Subscription fees are defined by Carrier Connection and are subject to change without notice.
- Late returns may incur additional charges at a rate of $5/day. Non-payment may result in a debt collection agency being engaged and possible police charges.
- Refunds will not be provided for equipment returned before the end of the rental period.
Replacement Fee:
The Renter understands that they are liable to pay a Replacement Fee and Restocking Fee if the rental equipment is not returned within 5 days of the end rental period or is returned in a state that is deemed to be unacceptable for future use.
- The replacement fee of each item of rental equipment will be defined by the recommended retail price of the product like for like, regardless of the age of the rental equipment hired.
- The Restocking Fee shall be an additional 20% above the Replacement Fee
- The replacement fee will be charged, as per the Replacement Fee listed on the item details page on the day the Replacement Fee is charged or current retail value whichever is greater. If the exact item is no longer available the replacement fee will be set based on the retail value (including shipping and handling) of a similar item currently available for sale.
- Renter agrees to pay the invoice for any such replacement fee within 48 hours.
- Carrier Connection reserved the right to modify, update, change, waive or otherwise change the Replacement Fee and Restocking Fee at any time.
Postage and Collection:
- The Postage Fee includes prepaid return tracked postage, the Renter is responsible for returning the equipment in the reusable packaging provided with the carrier.
- If the equipment is returned in alternative packaging or bundles are separated, the Renter is solely responsible for any additional postage fees.
- If Renter uses alternative shipping, items must be sent tracked and insured and tracking must be provided to Carrier Connection before the item can be considered returned.
- The Renter must ensure that the rented equipment is packaged safely and scanned by the appropriate carrier on or before the end of the rental period.
- If the rental equipment is not returned within the timeframe specified, further charges may be applied for replacement of the rental equipment - see Loss and Damages.
- The Renter may elect to collect from and return the rental equipment to the Carrier Connection location in Albany, NY. This must be pre-arranged at least 24 hours in advance, and is solely at the discretion of Carrier Connection, collection hours may be limited.
Equipment Available for Hire:
- Carrier Connection has a large range of products for sale and hire, including but not limited to: Stretchy Wraps, Woven Wraps, Ring Slings, Full Buckle Carriers, Half Buckle Carriers, Meh Dais, and Onbuhimos
- All rental equipment remains the property of Carrier Connection for the duration of the Rental Period unless a purchase agreement is arranged and any associated purchase invoice paid in full.
- The Renter can apply to buy the rental equipment by emailing Carrier Connection. The Return Postage* payments made for that specific product/s may be deducted from the purchase price.
- *If there are other rental products included in the Rental Agreement that the Renter wishes to return to Carrier Connection at the end of the Rental Agreement period, the Return Postage will not be deducted from the purchase price.
Use and Care of Equipment:
- The Renter agrees that Carrier Connection is NOT responsible for the safety of the renter or any children that may be placed in the equipment while in possession of the renter.
- The Renter agrees that they or anyone they permit to use the rental equipment are physically, mentally and medically capable of using the rental equipment, and that any child placed in the equipment meets the minimum recommendations for the specific equipment hired and is physically, mentally, and medically capable of being worn.
- The Renter agrees to use the rental equipment safely and strictly only for its intended purpose and in accordance with the manufacturer's instructions and any associated laws.
- TICKS babywearing safety must also be adhered to at all times. If you are unsure at any time, please contact Carrier Connection with photos, videos and/or questions.
- The equipment must not be modified, altered, or repaired without the prior written consent of a Carrier Connection representative.
- The Renter agrees to make every attempt possible to avoid the carrier coming into contact with smoke, pet hair and strongly scented fragrances.
- No animals are to be worn in Carrier Connection rental equipment.
- You must not take Carrier Connection rental equipment outside of the United States.
- Renter shall inspect each item delivered in accordance with this agreement. The Renter must immediately notify Carrier Connection of any discrepancies between the items received and the description of the items on the item pages. If Renter fails to provide such notice within 24 hours of the rental items being marked as delivered, the the Renter will be considered to have accepted the items as specified on the item details page.
Maintenance and Cleaning:
- The Renter shall return the equipment in the same clean and well-maintained condition as received. Failure to do so will result in a cleaning or maintenance fee, and may result in additional costs for damage/replacement (see below).
- The Renter is required to contact Carrier Connection for written permission and specific washing instructions in the instance that rental equipment requires cleaning.
- Specific carriers and manufacturers have different washing instructions which must be respected in order to limit risk of damage to rental equipment.
- Carrier Connection requests that IF washing permission is granted, the Renter follows all written and verbal instructions including but not limited to placing baby carriers inside a garments bag or pillowcase with all buckles fastened, using a low spin speed and sensitive liquid detergent, and strictly NO fabric conditioners.
- No Carrier Connection rental equipment can be dried in a tumble-dryer. Line-drying in the shade is essential to protect the integrity of the baby carriers.
- The Renter agrees to spot clean only without abrasive equipment or detergents unless prior discussion with Carrier Connection management.
- Structured carriers may be loaned with suck pads. If suck pads are included, Renter agrees to use them for the duration of the rental period.
- Suck pads are fitted to the shoulder straps to prevent damage to the carrier from children chewing on the straps, dribbling, vomit and excessive washing.
- Suck pads can be washed with the Renter’s normal washing.
- These must be returned with all rental equipment.
- Failure to return the suck pads will result in the replacement cost (including shipping and handling) being charged to your account.
- The Renter understands that rental equipment does not need to be washed prior to return.
Loss or Damage:
- All rental equipment is checked prior to being released to the Renter, and is loaned in a safe, undamaged condition.
- The Renter is responsible for any loss, theft, or damage to the equipment during the rental period. In the event of loss or damage, the cost of repair or replacement (as per the replacement fee listed on the item details page, regardless of the age of the rental equipment) will be invoiced. Renter agrees to pay any such invoice within 48 hours.
- The Renter must check buckles, stitching and accessories before every use and avoid damaging the carrier with items including but not limited to jewelry, Velcro or sharp objects.
- The Renter will not attempt to repair any part of a Carrier Connection rental product, and will not engage a third party to do so. Damaged carriers must be returned to Carrier Connection for formal assessment, to ensure that the carrier’s integrity and strict safety regulations are maintained.
- The Renter must promptly report any damage or loss to Carrier Connection.
Cancellation:
- The Renter may request to cancel before the rental period begins. Membership and rental fees are non-refundable. Shipping fees may be refunded at the discretion of management.
- Carrier Connection representatives reserve the right to cancel a rental request prior to the beginning of the rental period and refund all amounts paid.
Warranty:
- Carrier Connection makes no warranties, express or implied, as to the items rented. The Renter assumes responsibility for the condition of the equipment.
Liability:
- The Renter agrees to use the equipment at their own risk.
- Carrier Connection and all its representatives shall not be held liable for any injuries, accidents, or damages that may occur while using the rental equipment, included but not limited to the use of the equipment itself, advice given during online and in-person fittings, and any recommendations provided.
- The Renter is responsible for ensuring the safety and comfort of the child and adequate ergonomics and adjustments for all parties while using the baby carrier.
- The Renter is responsible for checking the integrity of the equipment prior to every use, and agrees to notify Carrier Connection immediately and discontinue use if any damage or loss is noticed during any part of the rental period.
- The Renter is responsible for ensuring that all people wearing and worn in a Carrier Connection baby carrier are medically fit and capable of using a baby carrier safely.
- Liability for injury, disability, and death of users or occupants caused by use of, handling, or transportation of the rented equipment during the rental period is the obligation of the Renter. The Renter shall indemnify and hold harmless Carrier Connection, its employees and affiliates from and against all such liability.
Communication:
- Carrier Connection will contact the Renter primarily by email or text message regarding the Rental conditions, postage/tracking, returns, overdue notices and additional fees/charges.
- All notices required or permitted under this agreement shall be delivered when delivered by mail, or email.
- The Renter agrees to inform Carrier Connection of any changes to their contact details at their earliest convenience, including name, email address, postal address, residential address and phone number.
- By renting the Renter agrees to contact from Carrier Connection and its partners as it pertains to the rental, offers, surveys, and marketing messages. Carrier Connection does not sell or distribute its mailing list to third parties.
Availability and Rental Periods:
- All hire items are rented out subject to availability, condition and suitability. While we do our best to honor requests, color and/or pattern are not guaranteed, if you are interested in renting a specific color because you are considering a purchase please contact us prior to placing your order.
- A maximum of three carriers can be hired at any one time.
- Rentals are available in 1-week, 2-week, 3-week, or 4-week increments.
- Items may be waitlisted - by placing an order, you agree to be added to the waitlist if your chosen item is unavailable. Rentals will ship when available, and bundle orders may be held until all items are in stock. If you're ordering with a library membership, it must be active at the time of shipping to receive member pricing.
- An extension to the original hire period may be approved at the discretion of Carrier Connection management, with appropriate upfront payment of extension fees required.
Rental Period Extensions
- The Renter may request to extend their Rental Period if they are a library member.
- The Renter must contact Carrier Connection at least 7 days BEFORE the end of the Rental Period to request an extension, and all invoices for extension fees must be paid before the end of the Rental Period. Late extension requests may be considered at management discretion.
- Extensions will only be granted pending carrier availability.
Late Fees
- The Renter understands that timely return of rental equipment is important for the ongoing success of the Carrier Connection Baby Carrier Hire Service.
- LOCAL: All rental equipment must be placed in the returns bin at Carrier Connection by 5pm on the final day of the Rental Period, which shall be 30 days from the pickup, unless otherwise extended in writing.
- ELSEWHERE: All rental equipment requiring postage must be packaged appropriately and scanned into the parcel system on or before the End Date specified in the Rental Agreement.
- If the rental equipment is not returned within the timeframe specified in the Rental Agreement, further charges may be applied for replacement of the rental equipment - see Loss and Damages.
- Late returns will incur additional charges at a rate of $5/day.
- These will be charged to the Renter in bulk every 14 days.
- After 28 days of non-return, the rental equipment will be assumed lost to Carrier Connection, and the Renter will be charged the full replacement value of all rental equipment in their possession or the late fees accrued whichever is the larger value.
- All rental fees are non-refundable, including late fees and replacement costs charged, and will not be refunded if the carrier is returned after the final overdue payment has been received.
- Non-payment beyond 56 days will result in a police report and a debt collection agency being engaged.
Apply to Buy
The Renter can apply to buy the rental equipment by emailing: baby.carrer.connection@gmail.com
- All rental equipment remains the property of Carrier Connection for the duration of the Rental Period unless a purchase agreement is arranged and any associated purchase invoice paid in full.
- The Return Postage* payments made for that specific product/s will be deducted from the purchase price.
- *If there are other rental products included in the Rental Agreement that the Renter wishes to return to Carrier Connection at the end of the Rental Agreement period, the Return Postage will not be deducted from the purchase price.
- Postage fees paid in order to receive the rental equipment will not be credited towards the final payout invoice.
- Rental equipment will be charged according to the specific product’s age and how many times it has been hired previously. Brand new rental equipment will be charged at the retail price as listed on the Carrier Connection website. Deductions for age and prior use of the carrier are at the discretion of Carrier Connection management.
Support:
- Carrier Connection encourages all Renters to send through photos for a fit check on their first use/s for feedback: via email baby.carrier.connection@gmail.com
- Library members can request additional follow up fit checks via email or post on the Carrier Connection Community group on Facebook.
Ownership
- All rental equipment remains the property of Carrier Connection until we relinquish ownership either:
- By an agreed sale to the Renter, with all invoices paid in full, or
- Following receipt of full payment for unreturned rental equipment 28 days after the end of the Rental Agreement.
Termination:
- Carrier Connection representatives reserve the right to terminate the Rental Agreement and reclaim the equipment if the Renter violates any terms or conditions outlined in this Agreement.
- Carrier Connection representatives reserve the right to cancel Rental Agreement in circumstances that are deemed to be high risk, or for repeat offenders of late returns.
Privacy:
All customer information is stored securely and will not be shared with any third party outside of Payhip and any associated apps utilized by the organization to maintain the website and its services, except where required by law.
Governing Law:
The Rental Agreement and its associated Terms and Conditions shall be governed by and construed in accordance with the laws of New York.
Severability
If any portion of this agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this agreement is invalid or unenforceable, but that by limiting such provision, it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.
Waiver
The failure of either party to enforce any provision of this lease shall not be construed as a waiver or limitation of that party’s right to subsequently enforce and compel strict compliance with every provision of this agreement.
Disputes Resolution:
If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting Carrier Connection directly. If the matter is not resolved by negotiation, the parties will resolve the dispute via mediation in accordance with any statutory rules of mediation.
Updates to the Terms and Conditions:
All previous versions of terms and conditions for Carrier Connection Carrier Rental Services are null and void. A current copy of this policy is available on the website.
Entire Agreement:
This Agreement, including the Agreement itself and these terms and conditions, constitutes the entire agreement between the parties and supersedes all prior agreements or understandings, whether written or oral.
By renting equipment from Carrier Connection, the Renter acknowledges that they have read, understood, and agreed to these terms and conditions.
